Lipsig Lawyers obtain $4.3 million for Albanian client

During March 2008, Thomas Moverman, one of the partners at the Lipsig Law Firm,obtained a $4.3 Million settlement for an Albanian client who was injured working in construction.  Mr. Moverman handled the entire case from start to finish up to when he handed the settlement check to the client and his wife.

Our client, 42-year old construction worker from Kosovo, was given a dangerous ladder to perfrom overhead work.  He was injured when the ladder fell.

We analyzed the facts and determined that the defendants had violated a special New York State Law called Labor Law 240(1).  We made a motion in the Court and proved the violation clearly.  The Court directed summary judgment in favor of our client.  We were fully prepared for the trial of out client's damages with two medical experts and an economist for the financial losses and expenses.

The worker had a right ankle fracture that needed an initial surgery and later a joint fusion surgery.  He spent less than one week in the hospital for both operations.  WE argued that our client could not return to his former career as a skilled construction worker due to his injury.

As the date for the trial approached, the insurance company requested that we meet with a mediator.  After a full discussion with our client, we turned down the  the offer of $2.5 million for settlement.  We prepared for the jury trial.  On the last day before the trial, the insurance company made higer offers and the case was settled for $4.3 million for our client.
